BOOKING TERMS AND CONDITIONS

As soon as Fernweh Fair Travel-Uplifting Communities receives a booking along with booking deposit from you, it is understood that you have read and understood the following Booking Terms & Conditions.

WHEN YOU'RE BOOKING INTO OUR TRAVELS

  1. Please understand that most of our trips are kind of exploration trips to off the beaten paths, and such trips require flexibility. The itinerary as shown in the website or in any of our promotional material is taken as a guideline only. Local conditions may require a slight change - this will only be taken if absolutely necessary.

  2. Once you have chosen the trip, we send you our pro forma invoice along with bank details and once you have paid the deposit, it is understood that there will be a contract between you and Fernweh for that particular trip.

  3. To secure your booking, a deposit of minimum 40% of the total trip cost is required. Balance amount should be sent to us at least one month before your trip begins. If you book within 1 month before the trip start date, the whole amount for the trip will be required immediately. Payments can be made by bank transfer, paypal or cash. If you wish to make payment by bank transfer, we will send you our bank details at the time of booking. Please note that applicable bank charges will need to be paid by the guest travelling with us.

  4. Fernweh will not be held responsible for denying clients from a trip if full payment has not been made before the due date.

  5. Your health, and your ability to undergo the trip is your responsibility. We do ask you to fill up a medical health form before a travel, but that is only for the information of the Fernweh staff on the trip, so they are aware of issues, if any.

  6. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

  7. India is full of surprises and you need to be flexible enough to take advantage of whatever comes along so that we may provide you with the best possible tour. There can be changes that occur at the last minute with hotels, transportation and other elements of the trip. We will address any surprises as they come, but we expect you to flex with the changes as well. If unexpected changes take place due to forces beyond our control, and if those changes cause extra expense in your journey, you are expected to cover those costs yourself. Fernweh Fair Travel is not responsible for expenses incurred due to last minute changes by hotels, delays due to traffic, airline delays, natural disasters, forces of nature, or anything else that is beyond our control.

  8. As this is a responsible travel you will need to be respectful towards the locals and guide. Please listen to the guide when we enter the villages or public places to follow certain traditional directions. In extreme case of being disrespectful towards the culture we may have to ask you to leave the group.

  9. Once the trip is booked and deposit paid, the following cancellation policy is applicable:

  • 90 days before the trip start date - no cancellation charge except admin charges 10%

  • If you cancel 60 days or more before the trip starts, you will receive a 80% refund.

  • If you cancel between 30-59 days in advance, you will receive a 50% refund.

  • If you cancel less than 30 days in advance there will be no refund.

  • No refund will be entertained for those who leave the trip due to sickness, injury or any other reason.

  • No refund will be given for any unused service.

  • If you plan to leave the main party mid-way, you will need to pay for your own meals and accommodation and any other possible charges that may apply.

  10. IMPORTANT NOTE: Whilst every effort is made to keep to all itinerary, clients will hopefully        appreciate that this is kind of exploration travel. Weather conditions, road conditions and vehicle breakdowns can contribute to the need for changes. Your guide will do everything in her/his power to see that you are inconvenienced as little as possible in such events.

  11. Please note: this cancellation policy also applies to trip cancellation (for you, individually or for the group as a whole) due to acts of God, or any unforeseen or unexpected events that are not within the control of the tour operators. For example, this means that if you have a death in the family one week before the trip which causes you to cancel the trip, you will not receive a refund. Similarly, if there is a terrorist event or earthquake, that makes it impossible or uncomfortable for the tour to take place, the same cancellation conditions and deadlines will apply.

Although we do not expect this type of event, we highly recommend that you get trip insurance, to cover this possibility. Most of the vendors on this trip will be paid in advance and these fees are not possible for the tour operators to recover once they are paid. If you elect not to get trip insurance you must assume the risk that, in such circumstances, you may lose all or part of your trip fee.

  12. Photographs and Video:

We reserve the right to take photographs and video during your trip. By traveling with us, you grant to us the absolute and irrevocable right and unrestricted permission to use and publish your image, or likeness, without compensation, for commercial, advertising, editorial, or any other purpose; and in any manner and medium, whether now known or hereafter devised; and to alter and composite the same without restriction and without your inspection or approval. You hereby release and discharge us from and against any and all claims, liabilities, costs, damages and expenses of any kind arising out of or relating to the use by us of your image or likeness. If you prefer that your image or likeness not be used, you must advise us in writing, no later than 30 days prior to your departure date.

Photographs and video of your trip may be submitted to us by you or by third parties such as (but not limited to) other travelers, tour guides, crew, or staff members.

  13. Jurisdiction:

All disputes pertaining to the tour and any claim arising herein shall be subject to the Court of Jurisdiction at Chamoli only.
